Who processes your personal data?
Personal data processing activities correspond to different data controllers, depending on the procedure or request to be carried out. The Register of Processing Activities (RAT), published in Informacion_V2_bis_firmado.pdf (mjusticia.gob.es), identifies the controllers of all processing registered in the Ministry.
What is the purpose of the processing?
The various purposes and their legal bases can be consulted when accessing each of the services and/or procedures offered by the Ministry; and, in general terms, in the RAT published in

You can find the detailed information or a link to access it for each treatment in the access to the procedure or in the corresponding forms.
Profiles will not be created nor will automated decisions be taken based on this personal data.
Which personal data is processed?
The personal data collected will be different depending on the procedure to be carried out.
What is the legal basis that legitimises the processing of the data?
The legal basis that legitimises the processing of data will be different depending on the procedure or request made by the citizen.
The specific legal basis for the processing in question will be indicated during the access to the procedure and/or in the forms.
In general, the processing is legitimized on the following grounds:
the processing is necessary for compliance with a legal obligation (Art. 6.1.c GDPR)
the processing is necessary for the achievement of a task carried out in the public interest or in the exercise of official authority (art. 6.1.e GDPR).
Exceptionally, some processing may be based on the data subject's consent.
How long will we keep the data?
They will be kept for the time necessary to fulfil the purpose for which they were collected and to determine any potential liabilities that may arise from said purpose and data processing. The provisions of the files and documentation regulations shall be applicable
To which recipients will the data be communicated?
When the processing of your procedure and/or request includes legal obligations arising from the legitimization of the processing that require the assignment or transfer to third parties, the third parties receiving such data and the purposes of their processing activities will be indicated in Informacion_V2_bis_firmado.pdf (mjusticia.gob.es)
No international transfer of your personal data is foreseen.
Which are the rights regarding your personal data?
In general, in order to exercise your rights, you must forward an e-mail to
dgtdaj.protecciondedatos@mju.es including a copy of your identity card or equivalent document, for correct identification.

Right of access
| This right allows you to be informed of the following:
The purposes of the processing, categories of personal data being processed and of any communications of data and their recipients. If possible, the period for which your data will be kept. If not, the criteria for determining this period. The right to request rectification or deletion of the data, limitation of the processing, or to oppose it. The right to lodge a complaint with the supervisory authority. If an international transfer of data takes place, to receive information on the appropriate guarantees. Of the existence of automated decisions (including profiling), the logic applied and consequences of this processing.

Right of rectification
| The right of rectification allows you not only to rectify inaccurate data, but also to have incomplete personal data completed, including through an additional statement.

Right to object
| This right allows you to object to the controller processing your personal data in the following situations:

The person in charge shall cease processing the data unless they can demonstrate compelling legitimate grounds that override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defence of legal claims When the purpose of the processing is direct marketing:
Exercised this right for this purpose, the personal data will cease being processed for such purposes.

Right of deletion
| With this right, you may request the erasure of personal data without undue delay when any of the following situations occur: If your personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
If your personal data must be deleted in order to comply with a legal obligation under Union or Member State law that applies to the Ministry of Justice.
However, this right is not unlimited, and it may not be possible to proceed with the erasure when the processing is necessary for compliance with a legal obligation, for the performance of a task carried out in the public interest or in the exercise of official authority conferred to the Ministry of Justice, for reasons of public interest, for archival purposes in the public interest, for statistical purposes, or for the establishment, exercise, or defense of legal claims.

Right to restriction of processing
| This right consists of obtaining the restriction of the processing of your data carried out by the Ministry of Justice when you contest the accuracy of your personal data, for a period that allows the Ministry of Justice to verify its accuracy. At the same time, this right allows you to ask the Ministry of Justice to keep your data, even if it no longer needs them for the purposes of processing, but you need them for the formulation, exercise or defence of claims.
